Application
• These general rental conditions apply to reservations and agreements regarding holiday home 'Le Moulin du Saon'
• In these general rental conditions, the term “tenant” is understood to mean: the person who enters into a rental agreement with the landlord regarding the rental of the holiday home
• Only these general terms and conditions apply, we reject other general terms and conditions (from you).
• Deviating agreements from these general terms and conditions are only valid if agreed in writing.
Article 1 - Reservations
1. We only accept reservations from persons who are 18 years or older. Reservations by minors are not valid. We reserve the right to refuse a reservation at any time without giving reasons. If a payment has already been made by you, the full amount will be refunded.
2. A placed booking is initially optional. A booking is only final after payment, which must be made within 3 days after booking. If no payment is made within 3 days, the booked dates will be released again.
3. After you have made a reservation, you will receive a confirmation and the invoice from us within 1 day. The conditions described under Article 2 apply to payment of the invoice.
4. We ask you to check these documents for accuracy and to notify us immediately of any inaccuracies. If you have not received a confirmation of receipt from us within 3 days after making the reservation, we request that you contact us immediately. If you do not report this within 3 days after reservation, you can no longer rely on the reservation, it has expired.
5. An agreement is concluded between you and us when we have confirmed the reservation to you and you have made the payment.
6. Parties/events are not allowed (we do not accept bachelor parties and similar parties).
Article 2 - Payment
The following conditions apply to payment:
1. You must pay the full invoice amount (including the deposit) within 3 days of the invoice date.
2. Payments must be made by transfer to IBAN: NL58RABO0363241604 in the name of. R. Rustenburg stating the invoice number.
3. When making the payment, you confirm that you have read and agree to the general rental conditions. The rent ends by operation of law after the agreed period has expired.
4. In the event of late payment, as described under 1. of this article, you will be in default immediately after the payment term has expired. In that case we reserve the right to cancel your reservation and dissolve the agreement.
Article 3 - Deposit
1. The tenant will be charged a deposit of € 300.00, which serves to guarantee damage and/or costs in the broadest sense of the word that we can withhold in the event of non-compliance with the obligations of the tenant as a good tenant and those who accompany the tenant.
2. The deposit must, as already described in article 2 under 1, be paid together with the payment of the invoice.
3. In the event that the deposit is not paid, we are entitled to deny the tenant access to the holiday home. If you fail to pay the deposit, we are also entitled to dissolve the agreement with immediate effect.
4. The deposit or any remainder thereof will be refunded to an account to be specified by the tenant within 14 days after departure after settlement of any claims (eg damage to inventory/holiday home and/or other costs). Any (further) claim for compensation will not be nullified by us by this refund.
5. If, in the event of (any) damage, it appears that the deposit is not sufficient to compensate for the full damage, we reserve the right to hold you liable for the (remaining) damage.
Article 4 - Changes
1. If the tenant, after the conclusion of the booking/agreement, wishes to make changes to the booking, we are not obliged to comply. It is at our discretion whether and to what extent changes are accepted.
2. If, after the booking has been made, the tenant wishes to change the period of stay to a different or non-consecutive/consecutive period of stay, the cancellation provisions as stated in Article 5 apply.
Article 5 - Cancellation
Cancellation by the tenant must always be made in writing by e-mail. The following conditions apply to this:
• In case of cancellation up to 90 days before the day of arrival, 0% of the rent is due. The full amount will be refunded to you.
• In case of cancellation up to 60 days before the day of arrival, 25% of the rent is due. The remaining amount will be refunded to you.
• In case of cancellation up to 30 days before the day of arrival, 50% of the rent is due. The remaining amount will be refunded to you.
• In case of cancellation from 30 days up to the day of arrival, 100% of the rent is due. No refunds will be made.
• If you have not arrived within 24 hours after the agreed date without further notice, this is considered a cancellation and 100% of the rent is due. No refunds will be made.
• In the event of cancellation by us, any amount already paid to us will be fully refunded to you. However, we will not be liable to refund any fees you may have paid to a third party in connection with your holiday (including, without limitation: travel, entertainment, activity or insurance fees).
Article 6 – Access holiday home and key
1. The key is to obtain resource 2 options. Pick up at 18 Rte des Bidots, 14330 Saon, France or from the key box on the shed which is provided with a code. Information about this can be found in the instruction email that you will receive a week before arrival. The renter is never entitled to duplicate the key for any reason whatsoever. Should the tenant do so anyway, the tenant will owe a fine of € 500. The key remains our property, it will only be made available to the tenant by us on loan. In case of loss, theft or any other way of losing the key, the renter owes an amount of € 100.
2. All costs that arise because you do not deliver the house on time will be recovered from you. We keep items of yours that are found after your departure for 4 weeks. We do not take any responsibility for keeping your items. Reshipping is only possible at your expense.
3. If you and/or other users have locked themselves out of the holiday home, you must contact us. If access to the house can be obtained again with another key provided, no costs will be charged. If the exclusion means that access to the holiday home can only be obtained again through a locksmith or damage caused to the lock, the costs will be recovered from you.
Article 7 - Stay in the holiday house house rules
The tenant and other users must behave as a good tenant during their stay in and around the house
1. Check-in/Departure
On the day of arrival you can check in from 16:00. On the day of departure, you must leave the holiday home before 10:00 am. You must leave the key in the mailbox at the entrance gate.
2. Basic Facilities
A number of basic facilities are present in the house at the start, such as toilet paper, kitchen paper, pepper/salt, hand soap, etc. If this runs out, you must arrange further supplements yourself for the rest of your stay in the house.
3. Garbage
There are 2 trash cans in the kitchen. 1 for plastic/cardboard (yellow bag) and 1 for residual waste (grey bag). Full garbage bags can be deposited in the garbage containers at the top of the driveway. Glass can be deposited in the glass bank in the village.
(Location of the bottle bank: Turn left from the driveway, then take the first turn left and the next turn left again. Drive straight ahead on the road L'Église, the glass container is on the left-hand side on the verge.)
4. Cleaning and final cleaning
The house must be clean and tidy on arrival. If this is not the case, please contact us as soon as possible.
The house must be left neat and tidy. If the house is not cleaned up, the extra cleaning time (outside the final cleaning paid by you at € 50) will be charged at 35 euros per hour. The total amount will be deducted from the refundable deposit after your stay.
Leaving it tidy means that:
- The house is tidy, i.e. put all household goods back in their original place.
- The refrigerator, freezer and dishwasher are left clean and empty.
- The cutlery and crockery have been washed and dried and stored in their original place.
- The washing machine is left empty and open.
- All trash cans are empty and the garbage bags have been left in the designated garbage containers.
- Used bed linen and towels are left on the floor in the bathroom. Fresh towels can be left on the kitchen table.
- If the BBQ has been used, it must be left clean and without ashes.
- The windows and doors are closed.
- Lighting is off.
5. Inventory
Contact us as soon as possible if items are missing from the inventory, so that this can be resolved.
It is not allowed to use bedding and furniture other than garden furniture in the garden.
It can always happen that something is damaged, report this as soon as possible, so that we can quickly fix this for the guests after you.
The house is checked for defects and missing items after each stay. The tenants are liable for damage caused by them, co-tenants or guests. Damage is initially deducted from the deposit. If there is more damage, the lessor will recover the non-covered damage from the lessee.
6. Terrain
During your stay, the holiday home and the adjoining garden next to the house are at your disposal. The surrounding area is also accessible, feel free to walk around or do activities on the lawn around the barns. However, it is not allowed to enter the barns. Always close the fences around the lawn because of cows that sometimes graze behind the barns. The outside area is secured by camera surveillance, your privacy has been thought of when placing it.
7. Sound
Between 22:00 and 07:00 you must limit noise so as not to disturb local residents.
8. Barbecue/Fire
The use of the BBQ is free if you clean it yourself afterwards.
Cleaning by us costs 35 euros.
The fireplaces in the house are for decoration and cannot be lit.
Making a (camp) fire on the site is not allowed due to fire hazard.
9. Smoking
Smoking in the house is not allowed. Smoking is allowed outside, provided that the cigarettes are neatly disposed of.
If these conditions are not followed, the deposit will not be credited.
10. Pets
Pets are not allowed.
11. Maximum number of persons
No more than 8 people + 1 extra child aged 0-3 years are allowed to stay in the holiday home, unless otherwise discussed with the landlord in advance. If this number is exceeded, the person who arranges the reception can deny access to the holiday home to these extra persons.
If at a later date, without our knowledge, extra persons come to stay in the house, a claim of 15% of the rent per extra person immediately arises. In certain cases, access to the home can be denied immediately without the right to a refund.
12. Parking
Next to the house there is space to park several cars, if there is insufficient parking space, you can also park along the driveway.
13. Charging electric car
There is a 16A power connection available, with your own cable / connection it is possible to charge your electric car, please contact us. Energy costs are charged for this.
Article 8 - Force majeure
1. Force majeure exists on our part if the performance of the agreement is wholly or partially, temporarily or otherwise, prevented by circumstances beyond our control, including danger of war, strikes, blockades, fire, floods and other disturbances or events. In the above cases, no refund will be made in the first instance. However, in those cases we will, out of goodwill, examine whether there are options for a partial or full refund of the amount to you.
Article 9 - Liability/complaints/damage
1. During the relevant rental period, the tenant and other users are fully and jointly and severally liable for all damage caused to the house, the inventory and all items belonging to the rented object, unless the tenant and other users can demonstrate/prove that the damage cannot be attributed to them. We advise you upon arrival at the holiday home to inspect the inventory for defects and if you find any damage or defects, to report this immediately and to make visual material of it.
2. We accept no liability for theft, loss or damage of or to goods or persons, of any nature whatsoever, during or as a result of the stay in the holiday home.
3. We accept no liability in the event of failure or non-operation of technical equipment, utilities and the (partial) failure of the WiFi and/or TV.
4. We accept no liability for construction activities on the (main) roads, etc. in the area.
5. The costs of periodic maintenance in/around the holiday home are for our account. If defects occur, the tenant must inform us immediately and follow our instructions as much as possible.
6. If you wish to submit a complaint after your stay in the holiday home, this must be submitted to us in writing and with reasons within 14 days after leaving the holiday home.
Article 10 - Departure and final cleaning
The house must be left neat and tidy. If the house is not cleaned up, the extra cleaning time (outside the final cleaning paid by you at € 50) will be charged at 35 euros per hour. The total amount will be deducted from the refundable deposit after your stay.
